          17.1 3 proposals numbered 1-3 below for consideration by Shanklin Town Council – As proposed by Councillor Chris Quirk (herewith – Cllr. Quirk’s notes (as presented) WHITE and Internal Auditor’s concerns 1 DARK BLUE & Auditor’s concerns 2 YELLOW)

          1. To agree in principle to acquire the Freehold of Shanklin Theatre from IOW Council.

          2. To authorise John Fleming, Richard Priest and Chris Quirk to negotiate terms for the transfer with IOW Council, subject to approval of the final proposals by Shanklin Town Council’

          3. In order that the Theatre does not close down for a prolonged period and lose what bookings it has, to authorise the Mayor so sign a "Licence to Occupy" for Shanklin Theatre with IOW Council to run from 14th April 2010 to 8th October 2010. During the "Licence to Occupy" IOW Council will remain responsible for the fabric of the building and its insurance, but Shanklin Town Council will be responsible for operating costs.*

      Councillor D. Bartlett – Councillor D. Bartlett has not attended any meeting of the council since May 2008 nor has any request been received to extend his period of absence beyond the 6 month period. Therefore as Councillor D. Bartlett has not attended a meeting for over six months in accordance with the relevant provision of the Local Government Act 1972 he is no longer a member of this Council and under section 86 of the Local Government Act 1972 the Town Council must formally declare this seat is vacant.

      No by-election will be held as we are now past the "cut-off" date for by-elections in the period leading to the elections in June 2009.
